Terms of Service

These Terms of Service ("Terms") govern your use of GutenForge, operated by Forgeborn ("we," "us," "our"). By creating an account or using GutenForge, you agree to these Terms.

1. The Service

GutenForge is an AI-powered newsletter generation platform. You provide brand information and topics; our service uses artificial intelligence to generate newsletter content, images, and email templates on your behalf.

2. Account Registration

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old to use GutenForge. If you are under 18, you must have parental or guardian consent.
• One person or legal entity per account. Shared login credentials are not permitted.
• You are responsible for all activity that occurs under your account.

3. Subscription and Payment

3.1 Plans and Pricing

GutenForge offers multiple subscription tiers (Starter, Growth, Pro, Agency). All tiers include the same core features; tiers differ in newsletter volume, storage, team seats, and brand slots. Current pricing is displayed at gutenforge.forgeborn.dev/#pricing.

3.2 Free Trial

New accounts receive a 30-day free trial of the Professional tier. No credit card is required to start the trial. At the end of the trial, you must subscribe to continue using the service.

3.3 Billing

Payments are processed by Stripe. Subscriptions are billed monthly or annually based on your selection. You can upgrade, downgrade, or cancel your subscription at any time from your account settings.

3.4 Refunds

We do not offer refunds for partial billing periods. If you cancel, you retain access until the end of your current billing period.

3.5 Overage

If you exceed your plan's newsletter limit, additional newsletters may be available at the overage rate displayed in your account. Overage charges are billed at the end of the billing period.

4. Your Content

4.1 Ownership

You retain ownership of all content you provide to GutenForge (brand information, text, uploaded images, prompts). You also own the newsletters and content generated by the service on your behalf.

4.2 License to Us

You grant us a limited license to process, store, and display your content solely for the purpose of providing the service. This includes sending your brand profile and prompts to our AI providers (Anthropic Claude, OpenAI DALL-E) for content generation. We do not use your content for training AI models.

4.3 AI-Generated Content

Newsletters and images generated by GutenForge are created using AI. While we strive for quality, you are responsible for reviewing all generated content before use. AI-generated content may contain errors, inaccuracies, or inappropriate material. You should review and edit all content before sending it to your audience.

4.4 Prohibited Content

You may not use GutenForge to generate or distribute:

• Spam or unsolicited bulk email
• Content that violates any law or regulation
• Content that infringes on intellectual property rights
• Deceptive, fraudulent, or misleading content
• Hate speech, harassment, or threats
• Malware, phishing, or malicious links
• Content depicting or exploiting minors

5. Website Scraping

When you provide a website URL for brand analysis, you confirm that you are the owner of that website or have express permission from the owner to analyze it. By submitting the URL, you are authorizing GutenForge to access it for the purpose of extracting brand information (colors, tone, style, and content). We only access the specific URL you provide.

6. Acceptable Use

You agree not to:

• Attempt to gain unauthorized access to other users' accounts or data
• Circumvent rate limits, usage quotas, or security measures
• Use the service to compete directly with GutenForge (e.g., reselling AI-generated newsletters as a service)
• Reverse-engineer, decompile, or disassemble any part of the service
• Use automated tools to scrape or extract data from GutenForge itself
• Impersonate another person or entity

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. GutenForge depends on third-party services (AI providers, payment processors, hosting) that may experience outages. We are not liable for service disruptions caused by third-party outages, maintenance windows, or force majeure events.

8. Intellectual Property

GutenForge, its name, logo, design, and underlying technology are the property of Forgeborn. You may not use our trademarks without written permission. The service uses open-source software components, each governed by their respective licenses.

9. Limitation of Liability

To the maximum extent permitted by law:

• GutenForge is provided "as is" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claim arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim.
• We are not responsible for the content, accuracy, or legality of newsletters you create and send using our service.

10. Account Termination

• By you: You can cancel your subscription at any time. Your data will be retained until you request deletion.
• By us: We may suspend or terminate accounts that violate these Terms, engage in abuse, or fail to pay. We will provide reasonable notice when possible.
• Effect of termination: Upon termination, you lose access to the service. You may request export of your data within 30 days of termination by contacting us.

11. Privacy

Your use of GutenForge is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

12. Changes to These Terms

We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Continued use of the service after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Connecticut, United States, without regard to conflict of law principles. Any disputes arising from these Terms will be resolved in the courts of Connecticut.
